Rally driver Maxine Wahome has been acquitted of the murder of her late boyfriend, Assad Khan, after the High Court found that the prosecution had failed to establish a case against her.
In its ruling, the court ruled that the DPP had not presented sufficient evidence to prove the murder charge against Wahome.
The court held that the evidence adduced by the prosecution fell short of the legal threshold required to sustain a conviction, leading to her acquittal.
Wahome had been charged following the death of Khan, who succumbed to injuries sustained during an alleged domestic incident. She had denied the murder charge throughout the proceedings.
With the acquittal, the court formally brought the criminal case against the rally driver to a close after finding that the prosecution had failed to prove its case beyond the required standard.
Maxine’s lawyer Steve Kimathi said that they are considering moving to court to challenge the manner which Maxine was paraded and charged
“I am extremely pleased with the Court’s decision to acquit Maxine. This is a case that should never have been brought before the courts in the first place, yet the Office of the Director of Public Prosecutions chose to pursue it. Today’s judgment is a vindication of my client’s innocence and, most importantly, it has cleared her name. I welcome the Court’s decision and are grateful that justice has prevailed,” he said
