MP Nabwera temporary protection from defamation by blogger

Lugari Member of Parliament Nabii Nabwera has secured temporary protection from a barrage of alleged defamatory statements circulating online, following an application filed at the High Court.

The application, dated November 10, 2025 and certified as urgent, seeks to restrain  George Opunga Tamata from posting, circulating, or publishing statements that falsely link the MP to the disappearance and death of Munyuki High School Principal,  Simon Isiaho Shange.

According to the court documents, the defendant allegedly disseminated “false, malicious, unqualified, inaccurate, and injurious statements via multiple social media accounts, including Kakamega Post, Malava Online, and Lugari Watchdog.”

The posts allegedly implied that Nabwera was involved in the principal’s disappearance and death, with statements such as “vanished after defying an MP” and “MP Nabwera Daraja Nabii come clean on the death of this teacher.”

Nabwera claims that the posts prompted threats against the MP’s home in Lugari, Kakamega County, and have allegedly caused significant reputational harm to the lawmaker.

In an ex parte ruling, the High Court granted an interim injunction, restraining the defendant from publishing the disputed material pending a full hearing. The inter partes hearing, where both parties will present their arguments, is scheduled for 20th November 2025.

Advocate Danstan Omari argued that granting the injunction serves the interests of justice, noting that no prejudice would be suffered by the defendant while ensuring that the MP’s reputation is protected from further harm.

This ruling offers MP Nabwera temporary reprieve from damaging allegations as the court prepares to scrutinize the matter in detail.
