Former Law Society of Kenya (LSK) president Eric Theuri has spoken out on the arrest of Boniface Mwangi, terming it ridiculous that the state intended to prefer terrorism-related charges on the renowned human rights activist.
Speaking to a live TV interview on Monday, July 21, 2025, the legal expert termed the levying of terrorism charges against individuals as a selective application of the law on what he terms a mere social problem.
“The attempt to charge Boniface Mwangi or any other person with acts of terrorism is ridiculous. It has no legal basis. You may want to use how terrorism is defined to show that some of those things happen, but it is more than that. It is the reason why the constitutional protection of being presented to court within 24 hours do not apply to terrorism. It is a serious criminal offence that involves a lot of issues on people planning death or destruction in a country,” he stated.
The lawyer has additionally urged the law enforcement officers to rethink their strategy of dealing with protesters and perceived government dissidents.
“I hope those advising the government will take a look and consider if at all they made the country safer or continue to make it unsafe. It is getting to a point where if I am arrested today, the concern of people is whether I will be alive tomorrow,” he added.

His remarks come after Siaya Senator James Orengo, also weighed in on the arrest of the activist.
In a statement, the outspoken governor termed the move as ridiculous, arguing that it goes against legal logic and foundational merits.
“By stretch of any tortured legal definition and factual foundation, it’s ridiculous to charge Boniface Mwangi and our children who have demonstrated a high level of political consciousness with terrorism,” Orengo’s statement read in part.
“Protected speech and political action should never be criminalised,” Orengo added.
The Directorate of Criminal Investigations (DCI) released a statement indicating that Boniface Mwangi was arrested in connection with claims of facilitating terrorist activities during the June 25, 2025, anti-government protests.
